Agreement to these terms

These Terms of Service are an agreement between you and the provider of My Date Night and apply when you access or use the My Date Night app, website, accounts, and related services (together, the “Service”). By using the Service, you agree to these terms and the Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use My Date Night. If you are under the age of legal majority where you live, you represent that a parent or legal guardian has permitted your use. You may use the Service only where permitted by applicable law.

Accounts and linking

You agree to provide accurate account information, keep it current, protect your password and link code, and promptly notify us through the developer support contact on My Date Night’s App Store product page if you believe your account has been compromised. You are responsible for activity under your account to the extent permitted by law.

A link code connects your account with another person’s account and gives that person access to shared plans, to-dos, and ideas. Share your code only with the person you intend to link. You are responsible for reviewing shared changes and for the content you choose to share with your linked partner.

Your content

You retain ownership of the plans, notes, photos, to-do items, ideas, and other content you add to My Date Night. You give My Date Night a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit that content only as needed to operate, secure, and improve the Service and share it with the partner account you select.

You represent that you have the rights needed to add your content and that doing so does not violate another person’s privacy, intellectual property, or other rights. You can remove individual content in the app. Account and data deletion are addressed in the Privacy Policy.

Acceptable use

You may not use My Date Night to break the law; harass, threaten, stalk, exploit, or harm another person; impersonate someone; upload unlawful, infringing, deceptive, or malicious content; access an account or data without permission; distribute malware; probe or disrupt the Service; bypass security or access controls; scrape or automate access except with written permission; reverse engineer the Service except where the law expressly allows it; or help anyone do these things.

We may remove content or restrict access when reasonably necessary to protect users, comply with law, investigate misuse, or preserve the security and operation of My Date Night.

Ideas, places, and reminders

Apple Intelligence suggestions

My Date Night may generate personalized date ideas on supported devices. Generated output can be incomplete, unexpected, or inaccurate. It is offered for inspiration, not as professional, safety, medical, legal, or financial advice. Review an idea before saving or acting on it.

Places and third-party information

Place search and map information may come from Apple or other third-party services. Addresses, hours, prices, availability, accessibility, and other details can change. Confirm important details directly with the venue and use appropriate judgment about travel, weather, personal safety, and activities.

Reminders

Notifications depend on your device, settings, permissions, software, and network conditions. My Date Night does not guarantee that a reminder will arrive at a particular time. Do not rely on My Date Night for emergency, safety-critical, or time-critical notices.

Together location widget

The Together widget is an optional convenience feature that uses the latest available locations from linked users to estimate distance and whether they appear to be together. Both people control location access on their own devices and may disable sharing at any time. Location readings can be delayed, unavailable, or inaccurate, so do not use My Date Night to locate someone or for emergency, safety, caregiving, or monitoring purposes.

Third-party services and Apple terms

My Date Night relies on services provided by Apple and Supabase. Your use of third-party services may be subject to their own terms and policies, and My Date Night is not responsible for third-party services or content to the extent permitted by law.

The My Date Night app is licensed, not sold. Unless the App Store product page provides a custom end-user license agreement, your license to install and use the app is governed by Apple’s Standard Licensed Application End User License Agreement. These Terms govern your My Date Night account and use of the Service and do not change your agreement with Apple.

My Date Night ownership

My Date Night and its design, software, branding, and other materials—excluding your content—are owned by or licensed to the My Date Night provider and are protected by applicable intellectual property laws. No rights are granted except the limited rights needed to use the Service under these terms and Apple’s applicable app license.

If you send feedback, you permit us to use it without restriction or payment, but you are not required to provide feedback.

Availability and changes

We may update, add, remove, suspend, or discontinue features to maintain or improve My Date Night, address security or legal requirements, or respond to circumstances outside our control. The Service may occasionally be unavailable, and features can vary by device, operating system, region, account status, or Apple Intelligence availability.

We do not promise that My Date Night will always be available, uninterrupted, error-free, or compatible with every device or software version. Where practical, we will try to provide notice of material changes that adversely affect active users.

Disclaimers and liability

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. This does not exclude warranties or consumer rights that cannot lawfully be excluded.

To the fullest extent permitted by law, My Date Night’s provider will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, opportunities, or goodwill arising from the Service. Total liability for claims relating to the Service will not exceed the greater of the amount you paid for the Service in the 12 months before the claim or US $50. These limits do not apply where prohibited by law, including liability that cannot be limited for fraud, willful misconduct, or personal injury.

Ending use of My Date Night

You may stop using My Date Night at any time. You may delete individual content in the app and request account deletion as described in the Privacy Policy. We may suspend or terminate access if you materially or repeatedly violate these terms, create risk or legal exposure, or threaten the security or operation of the Service.

When these terms end, provisions that by their nature should continue—including ownership, disclaimers, liability limits, and dispute provisions—will survive. Termination does not affect rights or obligations that arose before termination.

Changes to these terms

We may update these terms as My Date Night changes. We will post the revised terms here and update the effective date. If a change materially affects your rights, we will provide additional notice where required. Continuing to use the Service after revised terms take effect means you accept them, except where applicable law requires another form of consent.

General terms

These Terms and the Privacy Policy form the agreement about the My Date Night Service, while Apple’s applicable license governs the app license. If any provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the rest will remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or sale of the Service.

Applicable law governs these terms without taking away non-waivable consumer protections available where you live. Before starting a formal dispute, please contact us and give us a reasonable opportunity to resolve the issue. Nothing here prevents either party from using a court, tribunal, regulator, or other remedy available under applicable law.
